Vanderburgh County offers four (4) Pre-Trial Diversion Programs:
- FELONY PTD
- MISDEMEANOR PTD
- DRIVING PTD
- TAP/TEG COURSE/PROGRAM
These programs are voluntary programs that allow eligible offenders to ultimately divert their criminal charges into a supervisory program. Upon successful completion of the terms and conditions of their agreement, the charges will be amended dismissed. (The charges do NOT get expunged from the record with this program.) This allows the offender to avoid a criminal conviction, receive a second chance, and to obtain educational resources for future reference to avoid recidivism.
Each offender’s terms/conditions are individually tailored in reference to his or her current pending charges and case specific needs. Requirements could include community service, paying restitution/court cost/program fee, mental health evaluations and follow- through, substance abuse evaluations and follow-through, drug testing, obtaining a valid driver’s license, completion of defensive driving courses, weekly/monthly reporting, obtaining employment and/or enrolling in an educational course study, etc. Successful completion of all requirements is mandatory for a dismissal.
*** Qualification for Pre-Trial Diversion is based upon a criminal background history and the current pending charges. Eligibility is at the discretion of the Director of Pre-Trial Division and the Prosecutor. These Programs provide significant evidence-based intervention that holds the offender accountable and conserves judicial resources by diverting appropriate cases and offenders. Not every offender will qualify for a Pre-Trial Diversion program. You must be referred from court before enrolling into a program.
